Consumer fraud claims dismissed against online retailer

Lynch Rowin was successful in persuading Supreme Court, New York County to dismiss most of a lawsuit brought by a consumer who claimed that he had ordered and paid for merchandise online which was never delivered. Although the consumer can continue to seek damages for breach of contract, his claims for consumer fraud under the New York General Business Law, common law fraud, negligence, bad faith and public nuisance were dismissed.
