Commercial Litigation

Lynch Rowin's roots are in commercial and business litigation, which continues to be an important part of our practice. Our commercial cases have encompassed a wide variety of matters, including all types of corporate disputes as well as small business matters. In the course of our business representation we have handled contract disputes, zoning and real estate litigation, banking issues, including loan disputes, partnership disputes, including breach of fiduciary duty, all types of fraud, security agreements, product liability defense, environmental claims (both civil and criminal) and a wide array of other business issues.

We have handled trade secrets cases, obtaining at trial a permanent injunction barring a chemical company's former employee who had knowledge of the client's trade secrets from ever working for a competitor which had threatened to copy the company's products. We have also tried complex securities and other fraud cases, including one matter which resulted in a major appellate decision concerning the tort of negligent misrepresentation. Another one of our trials led to a leading appellate decision upholding a defendant's right to trial by jury when a plaintiff has sought both legal and equitable relief.

While litigation is at the center of our practice, we recognize that avoidance of what may be a protracted and expensive lawsuit is often in our client's best interest. For that reason, we attempt, where possible, to resolve controversies without resort to the courts. We use Alternative Dispute Resolution techniques, including mediation and arbitration. In addition, we review and negotiate contracts, employment agreements and leases to make sure that our clients' rights are protected and future legal controversies can be avoided.
